1. Introduction

These Terms of Service ("Terms") govern your use of the AI Humanizer MCP Server ("Service"), a Model Context Protocol (MCP) tool that integrates with AI assistants such as ChatGPT. By using the Service, you agree to be bound by these Terms.

AI Humanizer is a HumanizeAI.pro service owned and operated by Magura Digital OÜ, an Estonian company (registry code 16981402). The app's publisher or developer may be displayed as “Humanize AI” or “GPTinf” in ChatGPT or the OpenAI Platform. These are publisher names associated with this Service. These Terms are between you and Magura Digital OÜ, the legal entity responsible for providing the Service.

2. Service Description

The AI Humanizer MCP Server provides a text humanization service through the Model Context Protocol (MCP). The Service:

• Accepts text input via MCP tool invocations from compatible AI assistants
• Processes the text to generate humanized output
• Returns the processed result to the requesting MCP client

The Service is designed to transform AI-generated text into more natural, human-like writing.

3. Eligibility

By using the Service, you represent and warrant that:

• You are at least 18 years of age or the age of legal majority in your jurisdiction
• You have the legal capacity to enter into binding agreements
• You are not prohibited from using the Service under applicable laws

4. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You may use the Service to humanize text for legitimate purposes such as improving readability, adjusting tone, or refining content.

5. Usage Limits

To ensure fair access and maintain service quality for all users, the following usage limits apply:

• Monthly limit: 1,000,000 (one million) words per user per calendar month
• Per-request limit: Individual requests should not exceed 5,000 words

If you exceed these limits, we reserve the right to:

• Temporarily throttle or suspend your access to the Service
• Require you to wait until the next calendar month for limits to reset
• Contact you regarding a commercial or enterprise arrangement for higher usage

Usage limits may be adjusted at our discretion. Attempts to circumvent usage limits (e.g., using multiple accounts, automated rotation) are considered abuse and may result in permanent termination of access.

6. Prohibited Uses and Abuse

You expressly agree not to use the Service for any of the following purposes:

6.1 Fraudulent or Deceptive Activities

• Academic work: Submitting academic work (essays, assignments, theses, dissertations) that you represent as your own original work when institutional policies prohibit such use
• Creating content intended to deceive others about its origin or authorship
• Generating fraudulent documents, communications, or materials
• Circumventing plagiarism detection or AI detection systems for dishonest purposes

6.2 Illegal Content

• Processing content that violates any applicable law or regulation
• Creating, distributing, or facilitating illegal materials
• Content that infringes on intellectual property rights of others
• Content related to illegal activities, including but not limited to fraud, harassment, or threats

6.3 Harmful Content

• Content that promotes violence, hatred, or discrimination
• Content that exploits or harms minors in any way
• Content that constitutes harassment, bullying, or intimidation
• Malicious content intended to harm individuals, organizations, or systems

6.4 System Abuse

• Attempting to overwhelm, disrupt, or interfere with the Service (e.g., denial-of-service attacks)
• Attempting to probe, scan, or test the vulnerability of the Service
• Attempting to gain unauthorized access to the Service or its systems
• Reverse engineering, decompiling, or attempting to extract source code
• Using automated systems to send requests at a rate that exceeds reasonable use
• Circumventing any rate limits, access controls, or security measures

6.5 Commercial Misuse

• Reselling or redistributing the Service without authorization
• Using the Service to build a competing product or service
• Misrepresenting your affiliation with the Service or its operators

7. Enforcement

We reserve the right to:

• Monitor usage patterns for signs of abuse or violations
• Suspend or terminate access to the Service for users who violate these Terms
• Report illegal activities to appropriate law enforcement authorities
• Take any action we deem necessary to protect the Service, its users, or third parties

Violations of these Terms may result in immediate termination of access without notice.

8. Intellectual Property

The Service, including its design, functionality, and underlying technology, is owned by Magura Digital OÜ and protected by intellectual property laws. You retain ownership of any content you submit to the Service. By using the Service, you grant us a limited, non-exclusive license to process your content solely for the purpose of providing the Service.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. We do not warrant that:

• The Service will be uninterrupted, error-free, or secure
• The results obtained from the Service will be accurate or reliable
• The Service will meet your specific requirements or expectations

You acknowledge that AI-based text processing may produce unexpected or imperfect results, and you are solely responsible for reviewing and using any output.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Magura Digital OÜ SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Any loss of profits, data, use, or goodwill
• Any damages arising from your use or inability to use the Service
• Any damages arising from unauthorized access to or alteration of your transmissions or content

Our total liability for any claims arising from these Terms or your use of the Service shall not exceed the amount you paid us (if any) in the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless Magura Digital OÜ, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of a third party
• Any content you submit to the Service

12. Third-Party Services

The Service is accessed through MCP clients such as ChatGPT. Your use of such third-party services is governed by their respective terms and policies. We are not responsible for the actions, content, or policies of any third-party services.

13. Modifications to the Service

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

14. Changes to Terms

We may update these Terms from time to time. The updated Terms will be posted at this URL with a new "Last updated" date. Your continued use of the Service after any changes constitutes acceptance of the new Terms. We encourage you to review these Terms periodically.

15. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Republic of Estonia, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of Estonia.

16. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Magura Digital OÜ regarding your use of the Service, and supersede any prior agreements or understandings.
